Privacy Policy

In compliance with the provisions of the General Data Protection Regulation (GDPR) and the relevant Portuguese legislation (as amended and in force), MARIA VANA manages the personal data which are submitted by the user with the utmost care, ensuring in any case their protection and privacy.

The user may browse the website without being asked of any personal information from MARIA VANA, unless expressly otherwise informed by MARIA VANA. 

MARIA VANA will use the user’s personal data solely for the purposes which are hereinafter described.

MARIA VANA collects one type of information about the users: data that the user freely shares when sending a message via the website or the chat, subscribing the newsletter, filling in the form for the Mentoring Program or requesting a quote for any of the services provided.

MARIA VANA makes use of the personal data provided by the user while completing any of the forms, in order to be able to contact them. No extra or other type of personal data, apart from those that are considered as necessary, are collected or processed, to fulfill its intended purpose. 

When subscribing the newsletter, the user has the option to unsubscribe at any time.

The user may also specifically request for their data to be permanently deleted by sending an email to info@mariavana.com.

MARIA VANA will only use the user's personal data as defined in this Privacy Policy, unless the user has specifically given its consent to another use of their personal data. In the exceptional case that MARIA VANA intends to use the user’s personal data, which are processed based on their prior consent, for purposes other than those disclosed in the said consent, MARIA VANA undertakes to inform the user in advance and, in cases where the processing is based on the user’s consent, their personal data will be used for a different purpose only upon their relevant permission.

MARIA VANA will not use the user’s data for advertising purposes unless the user has given their explicit and free consent in that regard. 

MARIA VANA may need to use and maintain personal data for legal and compliance purposes such as the prevention, detection, or investigation of a crime, prevention of loss, fraud or any other misuse of its services. The user’s personal data may also be used by MARIA VANA for internal and external audit requirements, information security purposes, or to protect or enforce its rights, privacy, security, property or other persons.

MARIA VANA will not collect or process personal data of children under the age of 16 unless a parental consent has been given in accordance with applicable local law. If MARIA VANA realizes that a child’s personal data was collected in error, such data will be deleted without undue delay.

As a data subject, the user has specific legal rights regarding their personal data. The following list contains information about the user’s legal rights arising from applicable data protection laws:

Right to withdraw the consent: Where processing of personal data is based on the user’s consent, they may withdraw the consent at any time.
Right of rectification: The user may request MARIA VANA to correct the inaccurate personal data concerning them. MARIA VANA makes reasonable efforts to maintain the personal data held or controlled based on the most up-to-date information available. 
Right of limitation/restriction: The user shall have the right to obtain from the controller restriction of processing where one of the following applies:
(i) the accuracy of the personal data is contested by the data subject, for a period enabling the controller to verify the accuracy of the personal data;
(ii) the processing is unlawful and the data subject opposes the erasure of the personal data and requests the restriction of their use instead;
(iii) the controller no longer needs the personal data for the purposes of the processing, but they are required by the data subject for the establishment, exercise or defence of legal claims;
(iv) If the user has objected to the processing of their personal data, MARIA VANA verifies whether their legitimate interests override her own.
Right of access: The user may request information about the personal data MARIA VANA holds, including information about the categories and purpose of personal data in her possession, process or control, and to whom such data have been disclosed. The user may receive from MARIA VANA without any charge a copy of their personal data. MARIA VANA reserves the right to charge a reasonable fee for any further copies that may be requested.
Right of data portability: Based on the user’s request, MARIA VANA will transfer their data to another controller if technically feasible, provided that the processing is based on the consent of the user or is necessary for the performance of a contract. 
Right to erasure: The user shall have the right to obtain from MARIA VANA the erasure of personal data concerning them without undue delay in the following cases:
(i) personal data are no longer necessary in relation to the purposes for which they were collected or processed,
(ii) the personal data has been illegally processed.
Right to object: The user may at any time object to the processing of their personal data because of their particular situation, provided that the processing is not based on their own consent but in MARIA VANA legitimate interest or in the legitimate interest of third parties. In this case, MARIA VANA will no longer process the personal data of the user unless overriding legitimate reasons can be demonstrated.
Right to lodge a complaint with a supervisory authority: In the event of a suspected violation of applicable privacy laws, the user may lodge a complaint with the Data Protection Supervisory Authority in the place of their habitual residence, place of work or place of the alleged infringement.

MARIA VANA will attempt to satisfy any relevant user’s request within 30 days.

Generally, MARIA VANA will delete within 12 months the personal data collected from the user if it is no longer necessary to achieve the purposes for which such data were originally collected. However, it may be necessary to store personal data for a longer period because of legal provisions.
